A PURCHASE OR PAYMENT WILL NOT IMPROVE YOUR CHANCES OF WINNING.

1. ELIGIBILITY: This SUMMER SAFARI Sweepstakes (“Sweepstakes”) is open to all natural persons who are legal residents of the 50 United States and District of Columbia, who are at least 18 years old at the time of entry. Void outside the USA, in Puerto Rico, the US Virgin Islands, and other United States territories and possessions. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited by law.

2. SPONSORSHIP:  The Sweepstakes sponsor is YOGURT MOUNTAIN, LLC, located at 402 Industrial Lane, Birmingham, AL 35216. Sponsor and its respective affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees, and any entity involved in the development, production, implementation, administration, judging, or fulfillment of the Sweepstakes, including without limitation, the immediate family members of such individuals, are not eligible to participate. The sponsor will conduct the Sweepstakes substantially as described in these Official Rules.

3. ENTRY PERIOD: This sweepstake begins May 10th, 2021 at 12:01 AM CST and ends on July 31st, 2021 at 11:59 PM CST.

4. HOW TO ENTER: During the Entry Period, fill out the entry form below with name, phone number, and email address OR visit any YOGURT MOUNTAIN location and make a transaction of any amount using your Official YOGURT MOUNTAIN App. No further information will be required at the time of entry. The individual who fills out the form OR the owner of the account used to enter the sweepstakes MUST be 18 years or older at the time of entry. This Sweepstakes is in no way sponsored, endorsed, administered by, or associated with, LEVELUP, its parent company GRUBHUB or any of its subsidiaries. All entries become the property of YOGURT MOUNTAIN, LLC, and will not be acknowledged or returned. 

5. LIMITATIONS ON ENTRIES: Participants will receive one entry for every transaction of any amount through the YOGURT MOUNTAIN App at any YOGURT MOUNTAIN location, or by filling out the form below. No third-party entry or entry through any sweepstakes service is permitted. Any person who attempts or otherwise encourages the entry of multiple or false contact information under multiple identities or uses any device or artifice to enter or encourage multiple or false entries, as determined by YOGURT MOUNTAIN, will be disqualified. The use of robotic entry devices is strictly prohibited. 

6. PRIZE PACKAGE: Three (3) prize packages will be awarded, each of which will consist of: Four (4) tickets to a nearby zoo, transportation to the zoo, and food and beverage accommodations while at the zoo. Selection of transportation, zoo location, and allocation for food and beverage are solely within YOGURT MOUNTAIN’S discretion. Tickets to a particular zoo or event are not guaranteed. All other expenses not specifically mentioned herein are solely the winner’s responsibility. All travel is subject to availability and restrictions. The winner and guests must travel on the same itinerary. A minor may accompany the winner as a travel guest only if the winner is the minor’s parent or legal guardian. Minor must be accompanied at all times during trip by minor’s parent or legal guardian. Winner and travel guest must sign and return a travel release before travel occurs. Winner and guest must have all necessary identification and/or travel documents (i.e. valid U.S. driver’s license) required for travel. The winner understands there are inherent risks involved in travel and these risks may be present before, during, or after the trip. Winner agrees to accept the prize package “as is” and entrants hereby acknowledge that neither YOGURT MOUNTAIN nor LEVELUP is in any manner responsible or liable for any warranty, representation, or guarantee relative to the Grand Prize, including warranties provided exclusively by a prize supplier. Additional terms and conditions may apply to the airline, hotel, or event suppliers for which YOGURT MOUNTAIN and LEVELUP shall not be responsible or liable in any way for any cancellations, losses, or damages.  The approximate retail value of the prize package is $500, depending on fluctuations in prices of travel, accommodations, and event availability at the time of booking of the trip. Any difference between the stated approximate retail value and the actual value of the prize package will not be awarded. All travel must take place before December 31st, 2021 or the prize package will be forfeited. The winner is solely responsible for any federal, state, and local taxes. The winner must provide YOGURT MOUNTAIN with a valid Social Security number or taxpayer identification number before the prize will be awarded. A form 1099 will be issued to Prize Package winners.

7. DRAWING: Winners will be selected in a random drawing from among all eligible entries collected during the Entry Period taking place on or about August 2nd, 2021 at YOGURT MOUNTAIN’S corporate headquarters. The drawing will be conducted by YOGURT MOUNTAIN, whose decisions and interpretations on all matters relating to the Sweepstakes and these Official Rules are final and binding in all respects. YOGURT MOUNTAIN reserves the right to disqualify any entrant or winner and may refuse to award a prize to a person who is not eligible or has violated a rule gained unfair advantage in the Sweepstakes or obtained winning status using fraudulent means. If there is a dispute about the identity of an entrant, a prize will be awarded to the natural person to whom the email address is assigned by the internet service provider responsible for the domain associated with the submitted email address. If the winner is found to be ineligible or not in compliance with Sweepstakes rules, the winner will be disqualified and an alternate winner will be awarded the prize in a separate random drawing. The winner will be notified by telephone. The inability of YOGURT MOUNTAIN to contact the winner by telephone within seventy-two (72) hours after selection, may result in disqualification of the winner and an alternate winner may be selected in a random drawing at YOGURT MOUNTAIN’S discretion. Prize Package will be sent to the winner by U.S. mail within fourteen (14) days after the winner has been notified and accepted the prize. If the prize is returned as undeliverable, then the prize will be forfeited, and another winner is randomly drawn.

8. ODDS: The odds of winning will depend on the number of eligible entries received, according to the eligibility requirements in the Sweepstakes. 

9. WARNING: ANY ATTEMPT BY ANY PERSON, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY DAMAGE, DESTROY, TAMPER WITH OR VANDALIZE ANY SPONSOR-OWNED WEBSITE OR MOBILE APPLICATION OR RELATED SOCIAL NETWORKING SITE, THE ENTRY PROCESS, OR OTHERWISE INTERFERE WITH OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES, MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND YOGURT MOUNTAIN RESERVES THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL REMEDIES AGAINST SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

10. GENERAL TERMS: By entering this Sweepstakes, you promise to abide by Official Rules and decisions of YOGURT MOUNTAIN, which will be final and binding in all respects. The sponsor reserves the right, at its sole discretion, to refuse, disqualify, or withdraw any entry at any time. YOGURT MOUNTAIN will not be responsible for any injury, damage, or loss of any kind arising out of your participation in the Sweepstakes. YOU AGREE TO RELEASE, DISCHARGE AND HOLD HARMLESS YOGURT MOUNTAIN, ITS AFFILIATES, SUBSIDIARIES, EMPLOYEES, OFFICERS, DIRECTORS, AGENTS, AND ASSIGNS FROM AND AGAINST ANY OR ALL CLAIMS, LOSSES INJURIES, OR DAMAGES RESULTING FROM PARTICIPATING IN THE SWEEPSTAKES. Except where prohibited by law, by accepting the prize, the winner grants YOGURT MOUNTAIN a perpetual, worldwide, royalty-free license to use the winner’s name, photograph, voice, and/or likeness without further authorization, compensation, or remuneration of any kind for advertising, promotion, and other publicity purposes in any and all media now or hereafter known throughout the world.
